The head of state is the highest official who has the legal authority to govern and make decisions within the framework of the Constitution within a particular country, as well as the person responsible for the country's position on the world stage. In Russia, these functions are performed by the president. Accordingly, presidential decrees are the highest legal documents.
Definition
The function of the leader of a country of any status - a republic, a monarchy, a federation - is to make managerial, economic and other decisions designed to strengthen political, social, economic development. Officially documented decisions signed by the head of state are called "decrees of the president." These ordinances apply to the entire state. The main principle of these documents is the absence of contradiction to the fundamental law of the country - the Constitution. Thus, from a legal point of view, presidential decrees follow the Constitution and federal laws in order of importance.
Types of decrees
Documents issued by the leader of the state are of two types - normative and non-normative. Normative legal documents are of a general nature, that is, theyaction extends to an unlimited circle of persons, involves long-term and repeated use. These, for example, include a decree that approved the regulation on Russian state awards.
Besides this, there are also non-normative acts, which, in other words, are of an individual legal nature, that is, they have a targeted purpose. For example, documents releasing from office, or on appointment, are just such. Presidential decrees on awarding awards, military ranks, granting political asylum or pardons are of this nature.
Effective date
Regulatory decrees of the President of the Russian Federation acquire legal force seven days after their publication on official resources, and throughout the state entirely and simultaneously. If the documents contain information of varying degrees of secrecy or are classified as state secrets, such presidential acts become valid at the moment they are signed by the head of state.
In addition, there are decrees whose content is designed to eliminate legal gaps in the field of federal legislation. In this case, the deadline for their implementation depends on when the relevant bills are developed and adopted. In this case, the transformation of the decree into a legislative initiative with its further submission to the State Duma is implied.
