Most of the citizens of our country are well aware of the creak with which our legislature works. And the point here is not that the authorities pass few laws. On the contrary, there are plenty of laws in our country, but their implementation leaves much to be desired. And environmental legislation, which in Russia exists only on paper, suffers especially from this state of affairs. This is largely due to the fact that in our country these issues are in charge of Rosprirodnadzor, which, in turn, is subordinate to the Ministry of Natural Resources Protection.
This scheme reflects the whole essence of the domestic bureaucratic machine - a heavy and clumsy structure that cannot quickly and adequately respond to emerging needs. In addition, this state body, already weak and incapable of independent and quick action, is bound hand and foot by state restrictions.
Checks are the main deterrent. Or rather, the absence of them. This organization, which should be responsible for the prevention of environmental disasters, cannot even carry outunscheduled inspections, as their number and timing are strictly regulated by law. However, there is still such an opportunity - after the relevant decree of the prosecutor's office, where else do you need to turn.
At the same time, the frequency of inspection of commercial firms should not exceed once every three years! For such a long time, a company can repeatedly violate environmental legislation and easily evade responsibility without making any effort to do so. In the department itself, they bitterly report that more than one thousand oil pipeline breakthroughs in the country are recorded annually, and all officials get off with a maximum administrative pen alty.
So, as you can see, the concept of environmental law as such in our country is completely absent. How can this phenomenon be de alt with at the state level? Experts and members of environmental organizations believe that, first of all, it is necessary to make Rosprirodnadzor directly subordinated to the Presidential Administration and the Government. This will allow not only to actually comply with environmental legislation, but also to save the employees of the department from the networks of the bureaucratic red tape in which they find themselves.
Members of Greenpeace believe that not only those objects of environmental law that are prescribed in legislative acts, but also all industrial facilities, without exception, should undergo certification. Now, environmental disasters often occur due to the fault of those enterprises that simplynot included in the relevant register. Accordingly, it is simply impossible to check them without the necessary authorization from the Prosecutor's Office.
Thus, Russia's environmental legislation must be completely revised as soon as possible, otherwise the damage to the environment may be irreversible.
